Protection and fiduciary obligations

The principal shall warn the architect (planner) of dangers because of the fluid trust relationship resulting from the contract relationship:

  • Risks, which could be linked to the execution of the architecture contract.
  • Dangers, which are known to the principal but would only be difficult for the architect (planner) to recognise.

The principal can be liable for damages by neglecting to warn of dangers (OR 402 paragraph 2).
