The legal due dates vary depending on the applicable legal titles (mandate contract or work contract):
Mandate Contract (OR 394 ff.)
Basic principle
- Payments for a mandate contract invoice are due immediately.
Payment due date on the invoice
- If the architect (planner) sets a payment due date on the invoice, he grants a deferment until the expiration of the extended payment deadline.
Work contract (OR 363 ff.)
Basic principle
- The payment for work is – in absence of another agreement – due at the time of the delivery or the completion of the work (cf. OR 372 paragraph 1).
Delivery of uncompleted work
- Whether the delivery of an uncompleted work leads to a payment for the work being due is disputed.
