Contract execution

Introduction

The main performance obligation of the architect (planner) is in the obligation of the commissioned person to provide his services in good faith and to the best of his knowledge (OR 394 paragraph 1). The content and scope of his service obligation results primarily from the architecture contract and, if there is a lack of precise agreements, through the nature of the assignment or business transaction (OR 396 paragraph 1). If and to the extent nothing else has been agreed to, the contracted architect (planner) shall execute the contract personally.
